Telangana High Court Rules Children Have No Claim Over Mother’s Inherited Property

**August 24, 2024**In a recent ruling, the High Court has determined that children cannot assert rights over property inherited by their mother. The decision upholds a Civil Court order which validated a gift settlement deed through which a mother allocated one-third of her inherited property to her elder son.The case was brought to the High Court by the younger son, who contested the Civil Court’s approval of the gift deed. He argued against the mother’s authority to distribute her inherited property as she saw fit.After reviewing the case, the High Court’s bench concluded that the mother, as the legal owner of the property, had the full right to decide its distribution, including gifting it to her preferred beneficiaries. The court’s judgment reaffirmed the validity of the gift deed, reinforcing the mother’s autonomy in managing her inherited assets.
