Supreme Court Takes Strong Stand on Assaults Against Doctors, Questions Bail for Shiv Sena Corporator

New Delhi: The Supreme Court has taken a strong view of attacks on doctors and hospital staff.

The court indicated that people accused of assaulting medical professionals may not deserve the benefit of bail in serious cases.

A three-judge bench comprising Justices Vikram Nath, Sandeep Mehta and Augustine George Masih made the observations while hearing a plea filed by Shiv Sena corporator Ramesh Sukrya Mhatre.

Mhatre is accused of assaulting doctors and hospital staff at Shastri Nagar Hospital in Dombivli, Maharashtra.

The incident took place on July 6, 2026. Three municipal doctors were allegedly assaulted following an argument over the treatment of a woman patient.

Supreme Court Questions Bail

During the hearing, the Supreme Court questioned whether a person accused of attacking doctors should be granted bail.

The bench also indicated that it was inclined to cancel Mhatre’s bail.

However, the court decided to wait for the Maharashtra government’s plea seeking cancellation of bail before passing a final order.

The judges also observed that medical professionals must be protected while performing their duties.

The court questioned what would happen to patients if doctors became afraid to provide medical services because of threats or violence.

Bombay High Court Had Earlier Stayed Bail

Mhatre was initially granted bail by a sessions court on July 14.

The Bombay High Court later took suo motu cognisance of the matter and stayed the bail order on July 18.

The High Court also directed Mhatre to surrender.

On August 7, the Bombay High Court granted bail to Mhatre and other accused persons. However, it imposed stringent conditions.

The accused were directed to remain outside Maharashtra until the specified stage of the criminal proceedings.

The High Court also ordered a fast-track trial and fixed timelines for the investigation and filing of the chargesheet.

Supreme Court Defends High Court Intervention

The Supreme Court said the Bombay High Court was justified in taking suo motu cognisance of the bail order.

It also supported the High Court’s decision to stay the initial bail granted to Mhatre.

Mhatre’s counsel had challenged the High Court’s intervention and the strict bail conditions before the Supreme Court.

The Maharashtra government told the Supreme Court that it would file a separate plea seeking cancellation of Mhatre’s bail.

The Supreme Court will consider the state’s plea along with Mhatre’s petition.

The matter is scheduled for further hearing on September 7.

Doctors’ Safety at the Centre of the Case

The case has renewed attention on violence against medical professionals.

The alleged hospital assault involved multiple doctors, including a woman doctor. A video of the incident also circulated widely online.

The Supreme Court’s observations underline the seriousness with which courts are viewing attacks inside hospitals.

The final decision on Mhatre’s bail is expected after the court hears the Maharashtra government’s cancellation plea.
