Section 22A Turns Into Hyderabad Property Owners’ Biggest Fear

Hyderabad: For years, Section 22A of the Registration Act, 1908, was a provision that mainly concerned government officials, registration department staff and property lawyers. But in recent weeks, it has become a major source of anxiety for property owners across Hyderabad and neighbouring districts.

Section 22A allows certain categories of properties to be placed on the prohibited-properties list, effectively preventing their sale, transfer or mortgage through registration. The minister has also said that genuine property owners should not be denied relief because of errors in official records and promised corrective action.

Political controversy intensifies

The 22A issue has now developed into a major political flashpoint in Telangana. Opposition leaders have demanded an inquiry into how properties were added to the prohibited list and whether officials followed due process.

BJP leader and Union Minister G. Kishan Reddy has called for a judicial inquiry into the alleged irregularities, while BRS leaders have accused the government of mishandling the issue.

The BRS has also announced a legal cell to assist people affected by 22A restrictions.

Why Section 22A matters to buyers

For prospective buyers, the controversy has added another layer of due diligence before purchasing property in Hyderabad.

A buyer cannot rely solely on an old sale deed, tax receipt or building permission. The current registration status and the property’s presence or absence in the prohibited-properties list have become increasingly important checks before completing a transaction.

The Telangana High Court has also dealt with cases challenging properties placed on the prohibited list, including disputes over whether particular land parcels are government land or privately held property.
