Supreme Court Grants Bail to BRS MLC K. Kavitha, Questions Investigation Fairness

In a notable ruling, the Supreme Court has granted bail to BRS MLC K. Kavitha in the ongoing Delhi liquor policy scam case. Kavitha, the daughter of former Telangana Chief Minister K. Chandrashekar Rao, had been held in Tihar Jail as a remand prisoner for over five months.The decision, delivered by Justices B.R. Gavai and K.V. Viswanathan, comes amidst scrutiny over Kavitha’s alleged involvement in corrupt dealings related to the liquor policy. The Additional Solicitor General (ASG) Raju opposed the bail, presenting evidence he claimed showed Kavitha’s central role in the illegal transactions and the movement of illicit funds through channels linked to her.Despite the opposition, the Supreme Court chose not to evaluate the case’s merits at this stage. The bench criticized the fairness of the investigations conducted by the Enforcement Directorate (ED) and Central Bureau of Investigation (CBI), highlighting concerns over the selective nature of the accusations and the reliance on statements from a co-accused who had turned approver.The court acknowledged that the investigation was complete and found Kavitha’s continued detention unnecessary. Referring to the precedent set in the Manish Sisodia case, the Court emphasized that pre-trial detention should not amount to punitive punishment, noting that Kavitha’s five-month incarceration had been significant. Kavitha’s release on bail underscores the Court’s emphasis on justice and fairness in ongoing legal processes.
