*Allahabad, August 22* — The Allahabad High Court has granted interim relief to Aam Aadmi Party (AAP) leader and Rajya Sabha MP Sanjay Singh by staying the process issued against him by a Sultanpur Court. This decision halts the requirement for Singh to surrender before the trial court until August 22, the date set for his bail plea hearing.The Sultanpur Court had ordered the UP police to arrest and produce Singh by August 28 after he failed to attend a scheduled hearing in the case from 2001. Singh was involved in a protest against poor power supply in Sultanpur, alongside former SP MLA Anoop Sanda and others. Following their trial, six individuals, including Singh, were convicted in January of the previous year and sentenced to three months in prison.Singh’s counsel argued that he should be exempt from surrendering as he is scheduled to attend a crucial Joint Parliamentary Committee meeting on the Waqf (Amendment) Bill, 2024, on August 22. The court agreed, noting that Singh should not be confined before the revision petition is heard.The Additional Government Advocate (AGA) had contended that according to Allahabad High Court Rules, no bail application could be entertained unless the accused had surrendered. However, the Court found that the rule did not prevent it from exercising its inherent power to exempt the requirement of surrender in exceptional circumstances.The Court emphasized that a criminal revision petition is maintainable even if the applicant is not in confinement, thus granting Singh the interim relief he sought.
